The following provisions establish the general conditions of sale which govern the contractual relationship between the seller Edil Habitat SRL (hereinafter "Domus Habitat") and the customer (hereinafter "Customer or Consumer") having as their object distance selling, on Italian territory, of the products offered, via the e-commerce website https://www.domushabitata.com (hereinafter "the Site"). The seller is the company Edil Habitat SRL, with registered office in Via Manzoni ang. circ. – Altamura (BA) - ITALY – Company Reg. VAT number 04386310728
The general conditions of sale that apply to the contractual relationship between Domushabitat.com and the Customer are those published on the Site at the time the order is placed.
The order implies acceptance of these general conditions of sale. The Parties agree that the contract is governed by Italian law.
The Customer may request information and send communications by contacting Domushabitat.com customer service at the email address info@domushabitat.com.
The sales process through the Site was carried out in full compliance with the legislation on distance selling, electronic commerce, and in particular in compliance with the Italian Consumer Code Legislative Decree no. 206 of 6 September 2005 and subsequent. mod. and int.
The use of the distance selling process described in these general conditions of sale is reserved for consumers (hereinafter "the Customer" or "Consumers") who act on their behalf and are resident in Italy.
The purchase order via the Site implies knowledge and acceptance of these general conditions of sale.
The products covered by the contractual relationship governed by these general conditions are all the items published on the Site at the time the order is placed as specified in the "Products" section.
In the case of promotional offers with a specific duration, the Consumer must pay attention to the time limits of validity of the offer.
Acceptance of the offer
Acceptance and confirmation of the order are carried out by entering data in the following phases:
1. Adding the chosen products to the cart
2. Cart validation
3. Indication of personal coordinates
4. Selection of the payment method Until the stage preceding the "payment" you can modify the order by clicking on the "cart" icon at the top right of the screen.
In case of payment by credit card, the final acceptance by the Customer is made by entering his bank details (credit card number and expiry date).
In case of payment via Paypal or Shopify Payments, final acceptance by the Customer is made by entering the requested data on the Paypal or Shopify website.
In case of payment by bank transfer, the definitive acceptance by the Customer is made with the payment and subsequent crediting, to the current account indicated at the time of order confirmation, of the established amount.
The products and prices
The order
The order placed by the Customer presupposes acceptance of all the provisions of these general conditions of sale (choose the methods: electronically with the ticking of specific boxes or by resending the appropriately signed general conditions by fax or e-mail, as suggested in the end of this text).
Every order placed by the customer through online payment will be taken into consideration by Domushabitat.com only after acceptance of payment.
Domushabitat.com will send the Customer an order confirmation email which will include all the order details and information required by law: a summary of the General Conditions of Sale, pre-contractual information relating to the essential characteristics of the goods purchased , detailed indication of the price, the means of payment used, the payment instrument chosen, delivery costs, delivery terms, as well as information and instructions on the right of withdrawal and related costs, and legal guarantees.
The sale will be considered final after this confirmation, the availability of the product and the payment of the relevant price by the customer have been sent to the customer.
The contractual reference date, for the purposes of guarantee, withdrawal, etc., will be that of sending the confirmation and acceptance of the order.
To modify the order, the Customer can click on the "Your cart" icon at the top right of the screen.
Modification is always possible up to the stage before payment.
The Customer can cancel the order through his right of withdrawal according to the methods defined in the Withdrawal section; the request to cancel the order can be taken into account by sending an e-mail to info@domushabitat.com
(better to use certified mail, or write: by registered letter with return receipt to the registered office indicated above).
The order, once confirmed, CANNOT BE MODIFIED ONLINE either as regards the items or as regards the delivery address, without prejudice in any case to the right of withdrawal for the Customer.
The order which, after various delivery attempts by the delivery carrier, returns to the sender, cannot be returned. If the order has been paid, it will be refunded minus a penalty equal to the shipping costs incurred.
If the Customer wishes to change the delivery date of the package, he must contact the courier directly when the package is being delivered.
The Customer must keep the information contained in the order confirmation sent by Domushabitat.com on a paper or electronic document.
Any order that does not manifestly correspond to a retail sale and, more generally, any fraudulent order or any order presumed to be fraudulent, will be considered by Domushabitat.com as null and void and prosecuted in the appropriate judicial offices.
Confirmation and storage of the order
The order form will be archived in the Detic.it database for the time necessary for its execution and, in any case, within the terms of the law.
The order confirmation will contain the conditions, terms and methods of the right of withdrawal completed with the withdrawal form.
To access their order form, the Customer must access “Your Account” “Order Status”.
The summary of the instructions relating to accessing the order form will in any case be present on each order confirmation email.
In the case of an invoice request, the Customer must request it at the same time as the order, by sending an email to the address: info@domushabitat.com
Dispute regulation
In the event of a dispute arising from this contractual relationship, the parties undertake to seek, before any legal action, a solution dictated by common sense.
The parties agree that all disputes relating to sales through the website as described above will be referred to the jurisdiction of the Court of Matera.
The applicable law is Italian law. For anything not specified, reference is made to consumer regulations in force at the time of the order.
IT IS RECOMMENDED TO SEND A COPY OF THE GENERAL CONDITIONS AND REQUEST THEIR RETURN WITH SIGNATURE OF EACH PARAGRAPH FOR READING, AWARENESS AND ACCEPTANCE, OR SIGN AT THE END, but with reminder of the unfair clauses (indicate all the paragraphs, appropriately numbered and with a summary of their content: e.g. order, withdrawal, etc.).
