The following provisions establish the General Terms and Conditions of Sale governing the contractual relationship between the seller Edil Habitat S.R.L. (hereinafter “Domus Habitat”) and the customer (hereinafter “Customer or Consumer”) concerning the distance selling, within Italy and worldwide, of the products offered through the e-commerce website https://www.domushabitat.com (hereinafter “the Site”). The seller is the company Edil Habitat S.R.L., with registered office at Via Manzoni 192 – Altamura (BA) - ITALY – Business Register / VAT ID IT04386310728.
The General Terms and Conditions of Sale applicable to the contractual relationship between Domushabitat.com and the Customer are those published on the Site at the time the order is placed. Placing an order implies acceptance of these General Terms and Conditions of Sale. The Parties agree that the contract shall be governed by Italian law. The Customer may request information or send communications by contacting Domushabitat.com customer service at the email address: info@domushabitat.com.
The sales process through the Site has been created in full compliance with regulations regarding distance selling and e-commerce, and specifically in compliance with the Italian Consumer Code, Legislative Decree no. 206 of September 6, 2005, as subsequently amended and supplemented. The use of the distance selling process described in these general terms and conditions of sale is reserved for consumers (hereinafter “the Customer” or “Consumers”) acting on their own behalf. Purchasing via the Site implies knowledge and acceptance of these General Terms and Conditions of Sale. The products covered by the contractual relationship governed by these General Terms are all items published on the Site at the time the order is placed, as specified in the “Products” section. In the case of promotional offers with a specific duration, the Consumer must pay attention to the time limits of the offer's validity.
Acceptance of the Offer
Acceptance and confirmation of the order are carried out by entering data in the following stages:
1. Adding the chosen products to the cart.
2. Validating the cart.
3. Providing personal details.
4. Selecting the payment method. Until the stage prior to "payment," the order can be modified by clicking on the "cart" icon at the top right of the screen.
In the case of payment by credit card, final acceptance by the Customer occurs upon entering their banking details (credit card number and expiration date). In the case of payment via PayPal or Shopify Payments, final acceptance by the Customer occurs upon entering the required data on the PayPal or Shopify website. In the case of payment by bank transfer, final acceptance by the Customer occurs upon payment and subsequent credit of the established amount to the bank account indicated at the time of order confirmation.
Products and Prices
1. Price
The selling price of the products online on the Site, indicated in Euro or another currency, is the price in effect at the time the Customer registers the order. Prices include the VAT rate current at the time of the order. The selling prices of the products applied to the contractual relationship with the Customer will be those in effect and published on the Site at the time the Customer registers the order.
2. Product Characteristics
In accordance with Articles 52 and 53 of the Consumer Code, the company Domushabitat.com provides Consumers with information regarding the Products and, on the Site, informs Consumers of all the main characteristics of the Products offered (dimensions, composition, description, etc.) and the price, including taxes and duties. Product characteristics will be visible through digital or photostatic reproduction published on the Site, illustrating the offer as faithfully as possible. The image does not form part of the contractual relationship between the parties. Handcrafted (handmade) processing makes the product always unique and exclusive; furthermore, changes may occur due to image reproduction, therefore the Consumer acknowledges that the photograph of the Product on the Site is for indicative purposes only. All information is provided via the Site in accordance with Article 52 of the Consumer Code.
The Order
The order placed by the Customer assumes acceptance of all provisions of these General Terms and Conditions of Sale (choose method: electronic with checkboxes or by resending the general conditions duly signed via fax or e-mail, as suggested at the end of this text). Every order placed by the customer via online payment will be processed by Domushabitat.com only after payment acceptance. Domushabitat.com will send the Customer an order confirmation email containing all order details and information required by law: a summary of the General Terms and Conditions of Sale, pre-contractual information regarding the essential characteristics of the purchased goods, a detailed indication of the price, the payment method used, the chosen payment instrument, delivery costs, delivery terms, as well as information and instructions on the right of withdrawal and related costs, and legal guarantees. The sale will be considered final after this confirmation is sent to the customer, the availability of the product is confirmed, and the relative price is paid by the customer. The contractual reference date for purposes of warranty, withdrawal, etc., will be the date the order confirmation and acceptance are sent.
To modify the order, the Customer can click on "Your Cart" icon at the top right of the screen. Modification is always possible until the step before payment. The Customer may cancel the order through their right of withdrawal according to the procedures defined in the Withdrawal section; the request to cancel the order can be processed by sending an email to info@domushabitat.com (it is better to use certified email or write: by sending a registered letter with return receipt to the registered office indicated above). Once confirmed, the order CANNOT BE MODIFIED ONLINE, neither regarding the items nor the delivery address, without prejudice to the Customer's right of withdrawal. An order that, after various delivery attempts by the carrier, is returned to the sender, cannot be resent. If the order has been paid for, it will be refunded net of a penalty equal to the shipping costs incurred. If the Customer wishes to change the delivery date of the package, they must contact the courier directly while the package is in transit. The Customer must keep the information contained in the order confirmation sent by Domushabitat.com on a paper or digital document.
Any order clearly not corresponding to a retail sale and, more generally, any fraudulent order or presumed as such, will be considered null and void by Domushabitat.com and prosecuted in the appropriate judicial venues.
Order Confirmation and Archiving
The order form will be archived in the database (of Detic.it/Domushabitat) for the time necessary to execute it and, in any case, within the terms of the law. The order confirmation will report the terms, conditions, and procedures for the right of withdrawal, completed with the withdrawal form. To access their order form, the Customer must access "Your Account" > "Order Status." A summary of instructions regarding access to the order form will be present in every order confirmation email. In the case of an invoice request, the Customer must make the request at the same time as the order by sending an email to: info@domushabitat.com.
Dispute Resolution
In the event of a dispute arising from this contractual relationship, the parties commit to seeking a common-sense solution before any legal action. The parties agree that all disputes regarding sales through the website as described above shall be subject to the jurisdiction of the Court of Matera. The applicable law is Italian law. For anything not specified, reference is made to the consumer regulations in force at the time of the order.
IT IS RECOMMENDED TO SEND A COPY OF THE GENERAL CONDITIONS AND REQUEST THEIR RETURN WITH A SIGNATURE ON EVERY PARAGRAPH FOR READING, KNOWLEDGE, AND ACCEPTANCE, OR A SIGNATURE AT THE END, but with specific reference to unfair/restrictive clauses (indicate all paragraphs, appropriately numbered with a summary of their content: e.g., order, withdrawal, etc.).
